Crowdfunding Controversy: Japanese Indie Developer Faces Legal Battle Over Missing Funds

A Japanese independent game developer is currently embroiled in a legal dispute with a crowdfunding platform, alleging a substantial portion of funds raised for its upcoming title, a spiritual successor to the acclaimed '428: Shibuya Scramble', was never remitted. This situation has brought into question the reliability and transparency of crowdfunding mechanisms, particularly concerning developer protection and the handling of raised capital.

The game in question, 'Shibuya Scramble Stories', successfully surpassed its fundraising target on the Japanese crowdfunding site Ubgoe, accumulating an impressive 55 million yen (approximately $340,000) within a remarkably short period. This rapid success initially signaled a promising future for the project, building on the legacy of its predecessor, '428: Shibuya Scramble', a visual novel celebrated for its innovative detective narrative and use of live-action photography.

However, the celebratory mood quickly soured when Skeleton Crew Studio, the developer behind 'Shibuya Scramble Stories', revealed in March that it had only received 27.75 million yen from Ubgoe, barely half of the total amount pledged by backers. This discrepancy prompted the studio to initiate legal proceedings against the platform. Jiro Ishii, the executive producer, alongside legal counsel Takahiro Kasagi, has shed light on the unfolding events.

According to Ishii, Ubgoe was scheduled to disburse all collected funds by September 1, 2025. When this deadline passed without the full transfer, Ishii contacted Ubgoe's CEO, Kazua Okada. Okada reportedly attributed the shortfall to a "mistakenly wired" transfer to a different client. Following this, Okada signed a memorandum agreeing to complete the payment by September 16. However, only a fraction of the remaining sum was transferred by the new deadline. Okada again claimed the funds from the erroneous transfer had not yet been recovered. When pressed for evidence, such as transaction details or bank account information, Okada allegedly declined to provide them.

Legal expert Kasagi expressed skepticism regarding Okada's explanation, noting that in such business scenarios, banks typically allow for transaction reversals. The lack of transparent evidence from Ubgoe's CEO further fuels the developer's suspicion of deliberate obfuscation. Moreover, a critical clause in Ubgoe's terms and conditions states that project creators, not the platform itself, bear the ultimate responsibility to backers if funds go astray. Ishii admitted he was unaware of this liability when the campaign launched, stating his initial assumption was based on an inherent trust in human integrity within business dealings.

Despite the ongoing financial and legal challenges, Skeleton Crew Studio has secured additional support from Toyku Land Corporation, ensuring that the development of 'Shibuya Scramble Stories' will continue as planned. Ishii remains committed to pursuing the full recovery of the outstanding funds from Ubgoe, emphasizing the importance of accountability and justice for his team and the game's dedicated backers.
